Chubb Limited and its subsidiaries and affiliates (collectively, “Chubb”), are committed to protecting the privacy of visitors to our websites (“Websites”) and users of our mobile applications (“Apps”). It is important that our users understand how we collect, use and disclose Personal Information (as defined below). This Privacy Notice (“Notice”) is designed to help you obtain information about our privacy practices and to help you understand your privacy choices when you use our Websites and Apps.

References to “our”, “us”, “we” or “Chubb” within this Notice are to Chubb Limited and its operating companies, as applicable. Chubb processes Personal Information in accordance with applicable privacy and data protection laws in each jurisdiction in which it operates, including Australia, New Zealand, China (mainland), Macau SAR, Singapore, Hong Kong SAR, and India. Where required by applicable law, Chubb is responsible for determining how and why your Personal Information is processed when you visit our Websites.

What Personal Information does Chubb collect? How does Chubb collect such Personal Information?

“Personal Information” is information through which a natural person is identifiable or may be identified, either directly or indirectly. This may include your name, physical address, the company for whom you work, phone number, email address, details of the preferences you express to us, your comments and questions, and technical information from the devices you use to access our website or product you are registering (e.g. a device identifier) or the person/company that installed or maintains it. Chubb collects, uses and processes your Personal Information when you submit a form or request, or register a product with us in order to provide you with further information about Chubb’s services or products.

Sensitive Personal Information. In certain jurisdictions, additional categories of personal information are classified as “sensitive” and subject to stricter protections. For individuals located in China (mainland), “sensitive personal information” under the PIPL includes biometric data, religious beliefs, specific identity information, medical and health information, financial account information, location tracking data, and the personal information of minors under 14 years of age. We will only process sensitive personal information where we have obtained your separate consent (or where another lawful basis applies under the PIPL), and we will inform you of the necessity of processing and the impact on your rights before doing so. In India, under the DPDPA, we will process sensitive personal data only where necessary and with appropriate safeguards[.

The collection of Personal Information will be transparent to you, and you will have the opportunity to decide whether or not to provide it. However, please note that if you choose not to provide any of the Personal Information requested, Chubb may be unable to provide you with the information, services or products that you have requested. Where we need to collect Personal Information by law or to enter into or carry out a contract with you, and you do not provide the information, we may not be able to enter into or perform the contract, or we may have to suspend or cancel an existing product or service. We will notify you if this is the case at the time.

Chubb may also collect certain Personal Information through your use of our Websites or Apps, such as device identifiers, IP address, and log files. For further information on “How does Chubb use cookies or other tracking technologies?” please see below.

This Notice applies to all information we collect about you, information we collect directly from you, information we automatically collect, information we collect through our Websites, Apps and information we collect from third parties.

For individuals located in New Zealand, Chubb will not assign a unique identifier to you unless it is necessary for us to carry out our functions efficiently, and we will not require you to disclose any unique identifier assigned to you by another agency unless it is necessary to verify your identity or for another purpose permitted under the Privacy Act 2020.

You have choices when it comes to the technology you use and the data you share. When we ask you to provide Personal Information, you can decline. The consequences of declining are described above.

For individuals located in China (mainland), processing activities relying on “Legitimate Interest” as a lawful basis will be conducted in accordance with Personal Information Protection Law (“PIPL”) requirements. Where PIPL requires separate consent as the lawful basis (e.g., for sensitive personal information or cross-border transfers), we will seek such consent separately.

The lawful basis applied to each processing activity will depend on the applicable law in your jurisdiction. In jurisdictions where “legitimate interest” is not a recognized ground for processing (such as China under the PIPL, and Australia under the APPs), we will rely on other permitted grounds such as consent, performance of a contract, or compliance with a legal obligation.

Where the applicable law in your jurisdiction does recognize legitimate interest as a lawful basis for processing, we will ensure that our interests are balanced against your rights and freedoms before relying on this ground.

Where is Personal Information stored?

Because Chubb is a global company with locations in many different countries, your Personal Information may be transferred to, stored at and/or accessed from countries other than your own in order to accomplish the purposes listed above. The countries to which your Personal Information may be transferred include the United States, the member states of the European Union, the United Kingdom, Switzerland, Canada, Australia, New Zealand, China (mainland), Hong Kong SAR, Macau SAR, Singapore, India, Thailand, and the United Arab Emirates. We will only transfer your Personal Information in accordance with applicable law in your jurisdiction, using appropriate safeguards such as standard contractual clauses, governmental security assessments, professional certification, or consent, depending on the requirements of the applicable law.

For individuals located in New Zealand, we will only transfer your Personal Information overseas where we are satisfied that the overseas recipient is subject to comparable privacy protections, or where the transfer is otherwise permitted under the Privacy Act 2020.

Where required by applicable law (including the PIPL in China, the PDPA in Singapore, the PDPO in Hong Kong SAR, the Privacy Act in Australia and New Zealand, the DPDPA in India, and the Personal Data Protection Act in Macau SAR), we will implement the appropriate legal mechanism (such as standard contractual clauses, certification, consent, or a governmental security assessment) required for cross-border transfers from that jurisdiction. For individuals located in India, your Personal Information will only be transferred outside India in accordance with the DPDPA and any rules or regulations issued thereunder, including to countries not restricted by the Central Government. We will ensure that appropriate safeguards are in place for any such transfers

Does Chubb use your Personal Information to contact you?
Where you have provided your consent or where otherwise permitted by applicable law, Chubb may use the Personal Information you provide to contact you about products, services, promotions, special offers, surveys, and other information that may be of interest to you. If you would prefer not to receive such communications in the future, please use the “unsubscribe” link within any communications sent, or let us know by sending an email to [email protected]. Please note that if you unsubscribe from marketing communications, you may continue to receive non-marketing communications about your account or transactions with us.

For individuals located in Singapore, we will only send you marketing communications by electronic means (including SMS and email) where we have obtained your express consent (or where an exception under the PDPA or the Spam Control Act applies).We will also comply with the Do Not Call (DNC) Registry requirements, including checking and respecting DNC registrations unless a valid exemption applies. You may withdraw your consent at any time by using the unsubscribe link in any such communication or by contacting us directly. In Hong Kong SAR, Chubb will not use your Personal Information for direct marketing purposes without your consent under the PDPO, and you may opt out of direct marketing at any time.

We will also use your Personal Information to contact you in response to a direct inquiry or if you register to receive communications on any of the Websites, such as the Investors section if available.

Does Chubb share the information it collects with third parties?

Chubb may share your Personal Information with its affiliated companies and subsidiaries within the Chubb group for the purposes set out in the table above. Your Personal Information may also be shared with the parent company of Chubb, APi Group, a company with a registered office at 1100 Old Highway 8 NW, New Brighton, Minnesota, United States.

In addition, Chubb will provide access to or share Personal Information on an as-needed basis with third parties, including trusted service providers, consultants and contractors who are granted access to Chubb facilities and systems or which provide services to Chubb, and with government agencies and others as required by law.

Chubb may share Personal Information with such third parties for the following purposes:

  • to comply with Chubb’s legal obligations, including complying with tax and regulatory obligations, sharing data with labour/trade unions and works councils, and responding to a court proceeding or a legitimate legal request from law enforcement authorities or other government regulators;
  • to investigate suspected or actual illegal activity;
  • to prevent physical harm or financial loss;
  • to conduct web analytics on user interactions with our Website and Apps to improve our products and services; or
  • to support the sale or transfer of all or a portion of our business or assets (including through bankruptcy).

We require any third-party service providers that we use to respect the security of Personal Information that they process on our behalf, and only permit them to process your Personal Information for specified purposes and in accordance with our instructions.

Your Personal Information will also be maintained and processed by our service providers in the United States, the member states of the European Union, the United Kingdom, Switzerland, Canada, the United Arab Emirates, Asia, and in other jurisdictions, within an appropriate legal and contractual framework, including (where applicable) the data transfer mechanisms required by applicable data protection laws, as detailed above.

How does Chubb secure Personal Information?

Chubb is committed to ensuring the security and integrity of Personal Information. Chubb has adopted appropriate physical, technical, and administrative procedures to safeguard your Personal Information when stored within Chubb systems. However, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee or warrant that your transmission of Personal Information to us is completely secure. In the event of a data breach that is likely to result in serious harm or that otherwise triggers notification requirements under applicable law in any of the jurisdictions listed in this Notice, we will notify the relevant regulatory authority and/or affected individuals as required by applicable law.

How long do we keep your Personal Information?

We will only retain your Personal Information for as long as it is reasonably necessary for the purposes for which it was collected and to the extent permitted by applicable laws, including for the purposes of satisfying any relevant legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

Retention periods are determined with reference to the requirements of applicable law in each jurisdiction where we operate, including Australia, New Zealand, China, Macau SAR, Singapore, Hong Kong SAR, and India.

To determine the appropriate retention period for Personal Information, we consider the amount, nature and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

When data is no longer necessary for the purpose of collection and/or processing, it will be removed, archived, or otherwise deleted as appropriate.

Your Rights

a)Chubb respects your right to access, correct, and manage your Personal Information. The specific rights available to you depend on the privacy law applicable in your jurisdiction. The following is a summary of the rights that may be available to you.

  • Access. You have the right to request a copy of the Personal Information we hold about you. This right applies to users in all jurisdictions. Please note that in Hong Kong SAR, a reasonable fee may be charged for data access requests under the PDPO.
  • Correction / Rectification.. You have the right to have incomplete or inaccurate Personal Information that we hold about you corrected. This right applies to users in all jurisdictions.
  • Deletion. Erasure. You have the right to request that we delete Personal Information that we hold about you where it is no longer needed for the purpose for which it was collected, subject to any legal retention obligations. This right applies to users in: Australia, New Zealand, China, Macau SAR, Singapore, Hong Kong SAR, and India.
  • Objection. You have the right to object to processing of your Personal Information based on legitimate interests. This right is only available where the applicable law in your jurisdiction recognises this ground. This right applies to users in: Macau SAR and Hong Kong SAR.
  • Restriction of Processing.. You have the right to restrict our processing of your Personal Information in certain circumstances, such as where you believe the information to be inaccurate or our processing to be unlawful. This right is jurisdiction-specific and may not be available in all jurisdictions.
  • Consent Withdrawal.Where consent is the lawful basis for our processing of your Personal Information, you have the right to withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing carried out prior to withdrawal, but may affect our ability to continue providing you with certain products or services. This right applies to users in all jurisdictions where consent is the lawful basis for processing.

  • Automated Decision-Making. You have the right to refuse automated decision-making that has a significant impact on your rights and interests, and to request a human review of such decisions. This right applies to users in: China (under the PIPL).
  • Nomination. You have the right to nominate another individual to exercise your privacy rights in the event of your death or incapacity. This right applies to users in: India (under the DPDPA).
  • Explanation. You have the right to request an explanation of the rules governing our processing of your Personal Information. This right applies to users in: China (under the PIPL).
  • Personal Information Collection Statement (PICS). You have the right to request a copy of the Personal Information Collection Statement that was provided at the time of collection. This right applies to users in: Hong Kong SAR (under the PDPO).

How to Exercise Your Rights

To exercise any of the rights described above, please contact us by email at [email protected]. For your own privacy and security, we may require you to verify your identity before we can act on your request. We will respond to your request within the timeframe required by applicable law in your jurisdiction. You will not have to pay a fee to exercise your rights, except where the applicable law permits us to charge a reasonable fee (for example, data access requests in Hong Kong SAR under the PDPO), or where your request is clearly unfounded, repetitive or excessive.

What additional information should specific users know?

Parents, Guardians, and Children: Our Apps and Websites are intended for visitors who are at least 18 years of age, or the age of majority in their jurisdiction of residence. Chubb does not knowingly solicit information from, or market products or services to, children. If you do not meet the age requirements set out above, please do not enter your Personal Information on this or any other Chubb Websites or Apps. In India, under the DPDPA, we will not process the Personal Data of children (individuals under 18 years of age) without verifiable parental consent.
Users from the US: Chubb does not collect Social Security Numbers through its Websites.

How might Chubb change this Privacy Notice?
As Chubb expands and improves its Websites and its Apps, or as legal requirements change, we may need to update this Privacy Notice. Chubb may use cookies on this Website and its other Websites. Cookies are small text files sent to and stored on users’ computers. Web Beacons

Log Files

Chubb (or third parties on behalf of Chubb) may collect information in the form of log files that are recording Website activities and statistics about web users’ habits.

Log files are used for internal purposes only. By using log files, Chubb can constantly improve and customise its Websites and applications.

The entries help us gather, among other things:

  • Internal marketing and demographic studies;

Social Network Information

Furthermore, you acknowledge that we may use your personal information to match information with a social network for advertising purposes.

Chubb cannot make assurances about the security of information that you share with third parties, including information you share with social media sites.

Collection, Use and Disclosure of Credit-Related Personal Information

We may provide credit in connection with the supply of our goods and services. For this purpose, we collect credit-related personal information about individuals that apply for credit with us or who provide guarantees in respect of credit provided by us. We also collect credit-related personal information about directors of companies that apply for credit with us or provide guarantees in respect of credit provided by us.

We explain below the types of credit-related personal information we collect and how we use and disclose this information.

The types of credit-related personal information we collect

The kinds of credit-related personal information Chubb may collect about you include:

  1. your name, personal and work contact details (including post code), date of birth and driver’s licence or licence number;
  2. information about assets you own and any security held against those assets;
  3. information about court proceedings to which you are or were a party, and any court orders made against you, that affect your ability to make payments to us;
  4. any other information on your credit check report, such as credit providers you have commercial or consumer credit with and your payment history with these providers (including any defaults on payments);
  5. information about your history of payments, including any defaults on payments, for the goods and services we provide to you;
  6. information about your interactions with our collection agencies;
  7. any information about you provided by your trade referees;
  8. where applicable, information about any relevant insolvency event; and
  9. confirmation that you are not listed as a denied party by the United States government.

How we collect credit-related personal information

Chubb collects credit-related personal information about you when you fill out a credit application form. We may also collect this information from other sources, such as:

  1. credit reporting bodies;
  2. any trade referees you provide;
  3. publicly available sources;
  4. our contact for the company for which you are a director (when the company applies for credit or notifies us of a change in directorship);
  5. our collection agencies and external solicitors;
  6. if relevant, a company’s administrators and liquidators; and
  7. government bodies, such as the Australian Securities and Investments Commission, and the United States Government.

If you are a guarantor, we may also collect your name and contact information from the credit applicant.

Use of credit-related personal information

If you apply for and/or receive credit from Chubb, Chubb uses your credit-related personal information to assess your application for credit, manage your credit account and manage the collection of overdue payments (if necessary).

If you are a guarantor, Chubb uses your personal information to assess whether to accept you as a guarantor and invoke the guarantee (if necessary).

Disclosure of credit-related personal information

We may disclose your credit-related personal information to credit reporting bodies, our collection agencies and our external solicitors.

We may to disclose credit-related personal information to overseas recipients, including service providers in India.

Where we disclose credit-related personal information to an overseas recipient, we will take reasonable steps to ensure that the recipient complies with the applicable Privacy Principles.

Other information about our handling of your credit-related personal information

The following sections of this Privacy Notice apply to all personal information, including credit-related personal information.

Storage and Security of Personal Information (Including Credit-Related Personal Information)

Chubb stores your personal information in a combination of:

  1. hard copy files with restricted physical access; and
  2. electronic files stored on local servers or secure cloud platforms owned by Chubb, its related entities or their contracted service providers.

Chubb takes reasonable security precautions to protect the personally identifiable information that we collect from misuse, interference and loss and from unauthorised access, use, modification and disclosure.

Our service providers are contractually restricted from using or disclosing any personal information we disclose to them except as necessary to perform services on our behalf or to comply with legal requirements.

Retention of Personal Information (Including Credit-Related Personal Information)

Chubb retains personal information for the length of time required to fulfil the purpose for which it was originally collected, and for any additional period as required by applicable law or regulation, court, administrative or arbitration proceedings, or audit requirements.

What choices do you have about how Chubb uses your Personal Information?

Where possible, Chubb will provide you with the opportunity to decide whether or not to provide your personal information. There may be circumstances in which you will not be provided with a choice, such as IT security practices like virus and malware scanning for individuals with access to Chubb networks. Depending on the nature of the personal information and the reason that Chubb may require it, Chubb may be unable to fulfil your request without collecting and processing your personal information.

You will always have a choice about whether Chubb uses your personal information for marketing purposes. If you have provided us with your personal information and would now like to request that it is no longer used for marketing purposes, please contact the businesses from which you are receiving the marketing communications. The communications themselves and the business website will provide you with the contact details.

Access to and Correction of Personal Information (Including Credit-Related Personal Information)

You can request to access and/or correct your personal information by contacting us on the contact details at the end of this Privacy Notice. You may also request to access credit eligibility information about an individual held by us if you are assisting the individual deal with us and are authorised in writing by the individual to make the request.

We may request that you provide evidence to satisfy us as to your identity and, if you are not the individual about whom the personal information relates, your entitlement to access the information.

We may require you to pay our reasonable costs of supplying you with access to your personal information (such as retrieval costs). However, we will not charge you for making an access or correction request or to correct your personal information.

We will deal with your request for access and/or correction as soon as reasonably practicable. If the request relates to credit-related personal information, we will generally provide access or correct the information within 30 days, unless:

  • in respect of access requests, unusual circumstances apply; or
  • in respect of correction requests, we agree another period with you in writing.

In certain circumstances we will not be able to provide you with access to or correct your personal information. In these circumstances we will provide you with a written notice explaining the reasons for our refusal and stating actions you may take you if you are not satisfied with our response.

Privacy Complaints

If you wish to make a complaint about how we have handled your personal information, please contact us on the contact details set out at the end of this Privacy Notice. We may ask you to put your complaint in writing.

We will investigate and respond to your complaint as soon as is practicable after we receive it.

If your complaint relates to credit-related personal information, within 7 days we will acknowledge your complaint in writing and explain how we will deal with it. Depending on the nature of your complaint and the information to which it relates, we may need to consult with and/or notify particular credit reporting bodies or other credit providers. We will advise you of our decision in relation to your complaint in writing within 30 days of your complaint or such longer period as you agree in writing.

You may also contact:

  1. if you are in Australia, the Commonwealth Privacy Commissioner. If your complaint relates to our handling of your medical information in NSW or VIC you may also complain to the NSW Privacy Commissioner or the Victorian Health Services Commissioner; or
